Agreement Between User and Sandulela Technology (Pty) Ltd

This website (“the Website”) is owned and published by Sandulela Technology (Pty) Ltd, registration number 2002/021487/07 (“the Company”), which use is offered to you subject to the terms of use as contained in this document (“the Terms”). By visiting the Website or Linked Sites (“Use”), you are regarded as a “User” and are deemed to accept the Terms, conditions and notices as contained herein, which may be varied by the Company from time to time, without notice, and republished on the Website.

1. Links to Third Party Sites

The Website may contain links to other third-party websites (“Linked Sites”). Any such Linked Sites are not under the control of the Company and the Company is by no means responsible for the content, further links contained on the Linked Sites, or any changes or updates thereto. The Company furthermore is not responsible for any webcasting or any other form of transmission received by the User from any Linked Sites.

The Linked Sites, if any, are provided on the Website for the sole purpose of convenience to the User, and the inclusion of any link shall by no mean indicate or imply that the Company endorses the content contained on the Linked Site, nor any association with its operators.

The Company shall under no circumstances be liable to any User for any losses or damages suffered in consequence of the Use by the User of the Linked Sites.

2. No Unlawful or Prohibited Use

As a condition for the Use of the Website, the User warrants to the Company that it will not use the Website for any purpose that is unlawful or prohibited by the Terms. The User furthermore warrants that it shall not use the Website in any manner that could damage, disable, overburden or impair the Website or interfere with any other party’s use and enjoyment of the Website.

All content on the Website, including all imagery and text, is protected by copyright and may not be reproduced or appropriated other than as allowed by law in whole or in part in any form or via any medium without advance permission in writing from the Company.

Should the Company’s intellectual property rights be violated by the User, it reserves the right to pursue whatever actions may be necessary to prevent ongoing violation and to recover costs and damages through legal proceedings from the User.

Use of the Company’s trademarks or of substantively similar names or phrases including registering them as domain names is prohibited by law. The use of a third-party’s trademark on the Site are acknowledged as belonging to their respective owners.

3. Information and/or Materials Provided to the Company by the User

The Company does not claim ownership of any information, including personal, and/or materials provided by the User to the Company through the Website or which is posted, uploaded, inputted or submitted to the Company or on the Website (“Submissions”).

By the User posting, uploading, inputting, providing or submitting Submissions it thereby grants the Company, its affiliated companies and necessary sublicensees the right to use the Submissions in connection with the operation of its businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat the Submissions. Notwithstanding the aforementioned, the Company is under no obligation to post or use any Submission provided by the User and may remove and/or delete any Submission at any time, which right the Company may in its sole discretion exercise.

By posting, uploading, inputting, providing or submitting the Submission, the User warrants and represents that the User owns or otherwise controls all of the rights to the Submission as described in this section including, without limitation, all the rights necessary for the User to provide, post, upload, input or submit the Submissions. The User furthermore warrants the accuracy of the Submissions made.

4. Limitation of Liability – Disclaimer

Use of the Website creates no legal relationships between the User and the Company.

Whilst the Company aims to maintain the Site to a reasonable standard; errors, omissions and service interruptions may occur, and the Company accepts no liability in respect thereof or obligation for the continuous operation of the Website.

Any information or advice received from the Website should not be relied upon for any personal, medical, legal or financial decision made by the User. It is the responsibility of the User to independently verify any information obtained from the Website.

If the User is dissatisfied with any portion of the Website, or with any of Terms, the User’s sole and exclusive remedy is to discontinue its Use of the Website.

The Company reserves the right, in its sole discretion, to terminate the User’s access to the Website, without notice.

Unless expressly stated to the contrary, all the content of the Website is proprietary to the Company and/or its subsidiaries and/or its affiliates.
